1. Acceptance of Terms
By accessing and using the CVM Clovis Masonry website (www.clovismasonry.com) and requesting our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. CVM Clovis Masonry reserves the right to modify these terms at any time without prior notice. Your continued use of our services after any changes constitutes acceptance of the revised terms.
2. Services Description
CVM Clovis Masonry provides professional masonry services including but not limited to brick repair and restoration, chimney repair and rebuilding, tuckpointing and repointing, retaining wall design and installation, custom stone and paver patios, brick and stone steps repair and build, stone veneer siding and installation, paver walkways and driveways, outdoor fireplaces and kitchens, masonry foundation repair and waterproofing, commercial masonry services, and custom natural stone masonry. All services are subject to availability and may vary based on project requirements, materials, and site conditions.
3. Service Areas
We proudly serve residential and commercial properties in Clovis, CA and surrounding areas including Fresno, Madera, Sanger, Selma, Reedley, Fowler, Kerman, Kingsburg, Parlier, Dinuba, and Mendota. Service availability in specific areas is subject to our scheduling and capacity. We reserve the right to decline projects outside our service areas or beyond our expertise.
4. Estimates and Pricing
All estimates provided by CVM Clovis Masonry are based on the information available at the time of inspection and are subject to change. Final pricing may vary if additional work, materials, or unforeseen conditions are discovered during the project. We provide detailed written estimates that outline the scope of work, materials, labor costs, and estimated timeline. Estimates are valid for 30 days from the date of issue. We require written approval before proceeding with any work that exceeds the original estimate.
5. Payment Terms
Payment terms are specified in individual project contracts. Typically, we require a deposit to secure materials and schedule work, with the balance due upon project completion. We accept various forms of payment including cash, check, and credit cards. For larger projects, payment milestones may be established. All payments must be received before project completion. Late payments may result in suspension of work and additional fees. Returned checks will incur a service charge.
6. Project Timeline
While we strive to complete all projects within the estimated timeline, actual completion dates may vary due to weather conditions, material availability, permit delays, or unforeseen site conditions. We will communicate any delays promptly and work diligently to minimize disruptions. CVM Clovis Masonry is not liable for delays beyond our reasonable control. Project timelines provided are estimates and not guarantees.
7. Permits and Regulations
CVM Clovis Masonry will obtain all necessary permits for projects that require them. However, the property owner is ultimately responsible for ensuring all work complies with local building codes and regulations. We work closely with local building departments to ensure compliance, but changes to regulations or interpretation of codes may affect project requirements and costs. The property owner is responsible for any fines or penalties resulting from work performed without proper permits or in violation of local codes, except where such violations are directly caused by our negligence.
8. Warranties
CVM Clovis Masonry provides warranties on workmanship and materials as specified in individual project contracts. Structural masonry work is typically warranted for five years against defects in workmanship. Materials are covered by manufacturer warranties. Warranties do not cover damage caused by acts of nature, accidents, abuse, neglect, improper maintenance, or modifications made by others. To make a warranty claim, contact us in writing with a description of the issue and supporting documentation.
9. Limitation of Liability
CVM Clovis Masonry carries comprehensive liability insurance and workers compensation coverage. However, our liability is limited to the cost of the services provided. We are not liable for indirect, incidental, consequential, or punitive damages arising from our services or this agreement. Our maximum liability for any claim shall not exceed the total amount paid for the specific project in question. Property owners are responsible for protecting personal belongings and existing structures not directly involved in the masonry work.
10. Cancellation Policy
Either party may cancel a project with written notice. If the property owner cancels after materials have been ordered or work has begun, they are responsible for all costs incurred up to the cancellation date, including materials, labor, and administrative fees. Deposits for cancelled projects may be non-refundable if materials have been custom-ordered or if scheduling commitments have been made. If CVM Clovis Masonry cancels a project, we will refund all deposits and payments made, but we are not liable for any other costs or damages.
11. Property Access
The property owner agrees to provide safe and reasonable access to the work area for our crew and equipment. This includes ensuring access to water and electricity if needed for the project. The property owner is responsible for securing pets and ensuring the safety of occupants during construction. We will make reasonable efforts to protect landscaping and existing structures, but some disturbance may be unavoidable. Any damage to utilities or structures not identified during the initial inspection is the responsibility of the property owner unless caused by our negligence.
12. Dispute Resolution
Any disputes arising from these Terms of Service or our masonry services shall first be addressed through good-faith negotiation between the parties. If negotiation fails to resolve the dispute, both parties agree to attempt mediation before pursuing legal action. Any legal proceedings shall be conducted in the courts of Fresno County, California, and shall be governed by California state law. The prevailing party in any legal action may be entitled to reasonable attorney fees and costs.
